Terms and Conditions

1. Scope of Application

The General Terms and Conditions (AGB) refer to orders in the online shop, via the Instagram account @amourinfini_at, as well as orders via telephone and email. The AGB can be adjusted at any time.

2. Order Process and Contract Conclusion

A purchase request can be submitted at https://amourinfini.at/ by selecting an offered product. The automatically sent confirmation of this purchase request does not yet constitute a contract conclusion, but only the subsequent order confirmation.

Amour Infini Boutique GmbH reserves the right to reject purchase requests.

In the event of rejection of a request, no costs are incurred for the customer.

3. Delivery Conditions

Shipping is worldwide. An order is shipped 1 to 3 working days after receipt of payment. The postal route takes between 1 and 7 working days. Delivery to the customer takes place after payment of the purchase price has been received by Amour Infini Boutique GmbH.

When Amour Infini Boutique GmbH sends the goods, the risk of loss or damage of the goods only passes to the consumer as soon as the goods have been delivered to the consumer or to a third party designated by them. In the case of self-collection, the risk already passes with the handover of the goods to the customer.

4. Prices and Delivery Costs

All prices are in euros including tax.

For online orders, the prices displayed at https://amourinfini.at at the time of ordering apply. The amount to be paid by the customer (item price and delivery costs) is displayed to the customer as part of the online ordering process and can be checked again using the order confirmation sent to the customer.

Shipping costs are calculated individually.

5. Shipping & Payment Conditions

The products remain the property of Amour Infini Boutique GmbH until full payment.

For the time being, only payment by advance payment or bank transfer is offered for online orders.

Payment must be made in the currency shown on the invoice (euros) no later than 3 working days after receipt of the order confirmation. The ordered products are sent to the address specified in the order confirmation.

6. Warranty

The warranty is provided according to legal provisions, i.e. 24 months from receipt of goods. A guarantee is excluded.

A warranty case is when a defect was already present at the time of delivery.

7. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform Amour Infini Boutique GmbH by means of a clear statement by email to office@amourinfini.at of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Excluded from the 14-day return right/withdrawal right are orders that were personally collected or received and inspected. After ordering in the online shop and at the time of collection, however, you can withdraw from the purchase. However, once the purchased item has been accepted and paid for, the customer waives their right of withdrawal.

Consequences of Withdrawal

If you withdraw from this contract, we have to repay to you all payments that we have received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You must bear the cost of any loss during shipping. Therefore, it is advisable to insure the goods when shipping.

However, there is also the possibility to return the goods personally to the business address. In this case, I will receive the goods, inspect them in your presence and then immediately initiate the refund transfer.

In both cases (postal shipping or personal return), avoid damage and contamination of the goods, as you must bear the cost of these.

Please send/return the goods in original packaging with all accessories and packaging components. Please do not remove labels! If you no longer have the original packaging and have chosen postal shipping, please ensure adequate protection against transport damage with suitable packaging.

8. Data Protection

Customer data transmitted in connection with order processing is only used for internal market research purposes. Data is only passed on to third-party partner companies insofar as this is necessary for proper service provision (Post, DHL Express). The customer agrees to this use of their data through the purchase contract. The customer agrees that their data transmitted to us in connection with the order is stored and processed in our EDP system.

If customer data is transmitted but no contract is concluded, the correspondence and the associated data will be deleted after 6 months at the latest.

9. Arbitration Board

In accordance with the Regulation on Online Dispute Resolution in Consumer Matters (ODR Regulation), we would like to inform you about the Online Dispute Resolution Platform (OS Platform). Consumers have the possibility to submit complaints to the Online Dispute Resolution Platform of the European Commission at http://ec.europa.eu/odr?tid=121895914

However, we would like to point out that we are not ready or obliged to participate in dispute resolution procedures before a consumer arbitration board.

10. Force Majeure

In the event that we are prevented by force majeure or other circumstances beyond our control from fulfilling our obligations under a contract, we assume no liability.

If force majeure or other circumstances beyond our control cause a delay in delivery, we will fulfill our obligations as soon as possible under these circumstances.

11. Business Language

The business language is generally German. If required, however, order confirmation and invoice are also issued in English.
